You know the story by now—Masimo sued Apple over the blood oxygen sensor in the Apple Watch, and they actually won. The ITC was ready to pull the watch off shelves entirely. For most companies, that's a "start drafting the apology email to shareholders" moment.
But Apple's engineers looked at this problem and apparently thought: What if we just... didn't make it smart?
The Hack
Here's what they actually did. Masimo's patent specifically covers a watch that calculates and displays blood oxygen levels. So Apple issued a software update that essentially gave the watch a lobotomy.
Now? The watch just flashes lights at your wrist and collects raw optical data. That's it. It doesn't crunch a single number. It doesn't show you a percentage. It just beams that raw data to your iPhone, which does all the actual math and displays the result on the phone screen instead.
Legally, the Apple Watch is now just a "dumb sensor." It's basically a fancy pulse oximeter stuck to your arm with no brain. And legally speaking, that's apparently enough to dodge the patent. Masimo's lawyers were furious—the judge basically said "well, the patent says the watch can't calculate it, and now the watch literally doesn't calculate it."
The "Intern and the CEO"
I keep thinking about this in terms of office dynamics. The Apple Watch used to be the junior analyst who does the research and writes the report. Now they've turned it into the intern who just scans documents and dumps them on the executive's desk. The intern doesn't touch the analysis, so the intern can't be liable for bad analysis.
It's a ridiculous workaround that only works because Apple's ecosystem is so locked down that they can get away with making their own product worse without losing customers. Any other wearable company tries this? Their users switch to Garmin tomorrow. But Apple knows you're not leaving the ecosystem because your photos, your texts, your whole digital life is in there.
Why AI Wouldn't Have Thought of This
This is the part that keeps me up at night. If you fed this patent problem into an AI legal assistant, it would have tried to solve it inside the constraints. It would have attempted to write a new algorithm that calculated blood oxygen slightly differently, or looked for prior art to invalidate the patent, or suggested licensing negotiations.
It wouldn't have thought to step outside the box entirely and ask: What if the watch stops being the computer?
That's purely human lateral thinking. It's looking at a map and realizing you're not stuck on the road—you can just walk across the field. AI optimizes the paths it's given. Humans can decide the destination itself is wrong.
The Bitter Irony
The funny thing is, this "fix" makes the user experience objectively worse. You now have to pull out your phone to see your blood oxygen level, which defeats half the purpose of having health data on your wrist. But Apple calculated—probably correctly—that users would grumble and accept it rather than switch to Android.
It also sets up a fascinating precedent. We're going to see more of this "distributed computing as legal loophole" stuff. When patent wars get thick, companies will just start moving the brains of their devices to whichever piece of hardware isn't being sued that week.
Though I do wonder where it ends. Next year, will we need to pull out our iPhones just to check what time it is?
